At the behest of the parents, the daughter had accused of sexual harassment
A case was registered on that complaint. In 2022, the lower court convicted the accused. In this, three years imprisonment and a fine of Rs 5000 was ordered.
The judge said that in any case related to the Poxo Act, the testimony of the victim is very important. After the hearing, the judge found no evidence that any sexual intent was touched. Section 11 of the POCSO Act deals with charges of touching with sexual intent. The judge believes that this did not happen in this case.
In 2016, a 13-year-old girl was accused of sexual harassment by her father. The man alleges that when the girl was returning home on a bicycle, the accused came forward and tried to pull her face with malicious intent. A case was registered against the accused under several sections.
The victim said in her statement that she does not remember the name of the accused. He said that while returning home with a bicycle, he saw the young man standing. After this, the young man pushed him off the bike, then tried to strangle his face and throat.
Court acquits youth of sexual harassment charge
The court said that there was no allegation that the accused tried to touch the private parts of the girl, nor was there any attempt to remove her clothes. Later, the victim’s father said in his statement that the accused youth pushed his daughter from the bicycle.
He told that the student was returning by bicycle after taking tuition. At the same time the accused pushed her. Holding his mouth touched his private parts. The mother said that her daughter was thrown from the bicycle and dragged to the roadside. After this, the accused pulled her clothes and touched her private parts.
The judge observed in his observation that the statements of the girl’s father and mother had been exaggerated so that a case could be registered under the POCSO Act. The court acquitted the accused.
