ITR not filed and woman gets jail sentence
In India, if you do not file Income Tax Return (ITR), you can be sentenced to jail. Tisahajari Court of Delhi has sentenced a woman named Savitri to 6 months in jail for not filing ITR. There are provisions in the Income Tax Act of India that can send you to jail for up to 7 years if you file ITR.
The latest case is of Tis Hazari Court of Delhi, where the Income Tax Office had filed a complaint against a woman for not filing ITR. The woman had not filed income tax return on income of Rs 2 crore.

The woman had earned an income of Rs 2 crore in the financial year 2013-14, on which she had paid TDS of Rs 2 lakh. But no ITR was filed for this income. In such a situation, the woman paid only one percent of her income as tax. Whereas the tax demand on this income is high.

In Tis Hazari Court, Additional Chief Metropolitan Magistrate Mayank Mittal, after hearing the arguments of the entire case, imposed a fine of Rs 5,000 on the woman and also sentenced her to 6 months of simple jail. If the woman defaults in paying the fine, she will have to remain in jail for one more month.
Got 30 days time for appeal
On the petition of the woman, the court gave her 30 days relief from punishment and also granted her bail. The court said that if the woman wishes, she can challenge this decision further.
In this entire case, Special Public Prosecutor Arpit Batra says that here it was not important to punish the culprit in the case of tax evasion, but to prove the usefulness of this provision of the Income Tax Act. Not only this, it is also important for them to know that filing income tax returns is the responsibility of a citizen.
Filing your income tax return on time is mandatory under the Income Tax Law. If you do not do this, you may have to serve jail sentence along with fine.
