Fine on Google: The National Company Law Appellate Tribunal (NCLAT) ie National Company Law Appellate Tribunal has given a big blow to Google and said that it will have to pay a fine of Rs 1337 crore in 30 days. what is the whole matter
Explain that apart from Apple and some selected smartphones, Android OS is used in most of the phones and the operating system is from Google. In such a situation, many apps already come pre-installed in Android OS. So when the smartphone maker company wants to give Android OS in its smartphone, then those smartphone brands have to sign an agreement related to Google’s Mobile Application Distrubtion (MADA). Under this agreement, any company will have to deliver Google’s apps in its Android smartphone only after pre-installing them. No smartphone users can uninstall these apps at will. So CCI had fined Google for this.
what the bench said
After the heavy penalty imposed by CCI, NCLAT started hearing in this case from 15th February, which was ordered by the Supreme Court to deliver its verdict by 31st March. A bench of NCLAT Chairperson Justice Ashok Bhushan and Member Alok Srivastava said, “We are upholding the fine and directed Google to pay Rs 1,337.76 crore in thirty days after 10 per cent of the fine amount already deposited by it.” Will have to pay a fine of Rs.
