Judge Dinesh Mehta while giving the verdict said that in this case the effect will be on the family of both as well as the child, in such a situation the FIR lodged against the petitioner is quashed.

According to the police, the minor told that she had an affair with a 22-year-old man, where both of them made physical relations with mutual consent and she became pregnant. After this, the police had registered a case of rape against the youth under the POCSO Act.

The girl’s parents said in the court that the petitioner is ready to marry his girlfriend, in which case the FIR should be disposed of.

The court, while giving its verdict in this case, said that a 16-year-old girl fell in love with a 22-year-old youth, after which a son was born to both of them due to their ignorance. In the same case, after the statement given under 161 and 164, the girl accepted before the court that she had made relations with the petitioner with her consent.
