The Ministry of Home Affairs has told in the Lok Sabha that from the year 2019 to 2021, 81 Chinese citizens were given notices to leave India. At the same time, 726 Chinese nationals have been placed on the adverse list for visa rules and other illegal activities. According to the statement of the Ministry of Home Affairs, where the over-stay is found to be intentional or unreasonable. In that case appropriate action is taken as per the Foreigners Act 1946. Including issuing leave India notices to foreigners and levying fines or visa fees.
What did the Union Minister of State for Home Affairs say?
Union Minister of State for Home Nityanand Rai said that some of these foreigners stay for longer than the visa period due to ignorance or in essential circumstances like medical emergency or other personal reasons. Union Minister of State for Home, Rai said that in genuine cases where the overstay occurs unintentionally or due to ignorance or under compulsive circumstances, the period of overstay is regularized after levying the penalty fee and if necessary the visa is extended.

He said that where the overstay is found to be intentional or wrongful, appropriate action is taken as per the Foreigners Act 1946, which includes issuing a notice to the foreigner to leave India and levying fine and visa fee.
